Exclusive: Yuvraj Singh Sues Developer Over Broken Promises

Arbitration has been initiated by cricketer Yuvraj Singh against a developer in the national capital on the grounds of purported infringement upon his privacy rights during the developer’s promotion of a real estate project and non-compliance with the due date for delivery of an apartment in the project.

Two notices invoking arbitration have been sent by Singh to the developer, M/s Brilliant Etoile Private Limited. Advocate Rizwan presided over the law firm Rizwan Law Associates, which has provided counsel to the cricketer.

Singh claims that the developer has exploited his brand value and violated the provisions of the Memorandum of Understanding that was established between the two parties on November 24, 2020, in the notice regarding his privacy infringement.

Singh was required to promote and endorse the aforementioned initiative per the MOU. Last November, on November 23, the MOU expired.

Singh is dissatisfied with the purported ongoing commercial utilization of his services, which includes the utilization of his photographs on billboards, the project site, social media posts, articles, and more, despite the Memorandum of Understanding having expired.

The cricketer asserts that this completely violates his Intellectual Property Rights, which include his Right to Publicity and Copyright, which are protected by law.

According to the second notice pertaining to the possession of a flat in the development, the developer has violated the Agreement to Sale by failing to comply with the delivery timeline and schedule.

Singh has additionally claimed that the developer reduced the quality of fixtures, furnishings, lighting, and finishing, in addition to compromising on the material quality of the apartment.

The cricketer has additionally claimed that the developer has breached the Agreement to Sale through unsatisfactory and unhygienic conditions, unfulfilled promises, and an increased price that exceeds the current market value.
